Before you purchase a theme or product from BrillThemes.com, please make sure you have read, understood, and agreed to all the terms. By using BrillThemes themes and/or other products, we assume you’ve accepted the terms and conditions given below.
1. Theme License
a. Licenses
The Free License allows you to use the theme on multiple domains, but you must include a credit link back to BrillThemes.com.
The Single License allows you to use the theme on one domain.
The Developer License allows you to use the theme on multiple domains.
If you have purchased a single license, it is not permitted to use the theme on more than one domain. If you have downloaded a theme for free, you must include a followed, credit link back to our site.
b. Ownership and Unauthorized Use
You may not claim copyright, exclusive or intellectual ownership to any of our products, either modified or unmodified. All products including themes are the property of BrillThemes. With the purchase of a theme, you obtain ownership the right to use the theme. It is strictly forbidden to put our products in a modified or changed or even unmodified version on a disk, website, P2P or any other medium and use it for resale or sharing purposes.
c. Modifications
You are allowed to make any changes and modifications in the themes or products to suit your needs. It is not permitted to change or remove the copyright information in the source code. This includes the all PHP, JavaScript, HTML and CSS files distributed with our products. Of course, any visual copyrights, for example the copyrights in the theme footer, can be removed.
You are not allowed to resale or redistribute any changes or modifications as GPL or other licenses. It is strictly prohibited to port BrillThemes themes and themes included in our extensions to other platforms and content management systems.
d. Transfer of Ownership
It is not allowed to sub-license, assign, or transfer your licenses to anyone.
2. Payment and Delivery
After your payment has been made through our E-Junkie Shopping cart and we successfully received the transaction, you will get an e-mail with the download link that will allow you to download the theme 5 times with a 120 hours expiration window. If you don’t receive this e-mail please contact BrillThemes.
3. NO-REFUND POLICY
As our themes are sold as non-tangible, irrevocable, digital goods, all sales are final. No refunds will be given for software that is delivered via digital download from our site. Since BrillThemes Products cannot physically be returned. An explicit and detailed overview of the Product is provided in the service. If there is a problem with one of the digital download products or if you experience any difficulty with its download, we will fix the problem.
4. Photoshop Files License
The photoshop design files for our themes (both basic and developer) come packaged separately and are not GPL licensed. They are licensed and copyrighted under BrillThemes.com. You are not allowed to redistribute these files in any way.
5. Site Content
All content, including imagery, published on the BrillThemes.com domain is property of BrillThemes and under copyright. Any replicated site content must be authorized and clearly referenced back to the source. Content from the BrillThemes web site shall not be used or exploited for any commercial and non-private purposes without the prior written consent of BrillThemes.
6. Theme Support
We provide technical support for BrillThemes products only in our support forum in the member area and NOT by email. We also do not offer any formal priority support for customizations. Nevertheless many members of the BrillThemes community will help you with the installation, modification or administration of the themes when requested in the forum.
7. Price Changes
BrillThemes reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, a price with or without notice.
8. Warranty
Our products are provided “as is” without warranty of any kind, either expressed or implied. In no event shall BrillThemes be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products. Browser compatibility should be tested viewing the demonstration installations on the demo sites. Please ensure that your browser works with the theme. We do not guarantee that the products will work with all third party extensions.
9. Site Terms of Use Modifications
BrillThemes may revise these Terms of Use for its Website at any time without notice. By using BrillThemes you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
